Please read carefully before using this service. By submitting payment, initiating a scan, or engaging with Scan My Shadow in any form — you confirm that you have read, understood, and unconditionally agreed to these Terms in full. If you do not agree, do not use the service. Your continued use constitutes binding acceptance.

01. Acceptance of Terms

By accessing or using Scan My Shadow — including by initiating a scan, submitting the scan form, or making a payment — you agree to be legally bound by these Terms and Conditions, our Privacy Policy, and our Refund & Cancellation Policy, all of which together form a single binding agreement between you and Jaishree Exports.

If you are using this service on behalf of another person, you warrant that you have obtained their explicit written consent and that you are authorised to bind them to these Terms.

These Terms apply equally to both service tiers: the ₹298 Privacy Audit and the ₹998 Deep Dive.

02. Nature of Service

Scan My Shadow is an informational privacy audit service. It allows users to check whether their personal data (phone number, email address, and/or facial image) appears in publicly known breach databases, open-web sources, or image-indexed platforms.

The service is offered in two tiers:

  • ₹298 Privacy Audit — Automated phone and email scan delivered within 5 minutes of form submission; manual image scan delivered within 24 hours. All reports are delivered to the email address provided on the scan submission form.
  • ₹998 Deep Dive — An in-depth manual investigation, offered only when hits are identified in the ₹298 audit. Delivered within 48 hours to the email address on file. All terms herein apply equally to this tier.

Scan My Shadow is a reporting and awareness tool only. We do not remove data, contact third parties, provide legal advice, take enforcement action, or guarantee any specific outcome.

Breach source names displayed in reports refer to publicly known, previously disclosed data breaches. Scan My Shadow makes no claim regarding the current security posture of any named organisation.

03. User Consent, Eligibility & Permitted Use

By using this service, you represent, warrant, and confirm that:

  • You are at least 18 years of age.
  • You are scanning only your own phone number, email address, and/or photograph — or that of a person who has given you their explicit, informed, written consent to do so.
  • You are not using this service to investigate, surveil, or gather information on any third party without their knowledge and consent.
  • Your use of this service complies fully with all applicable Indian laws, including but not limited to the Digital Personal Data Protection Act, 2023 (DPDP Act), the Information Technology Act, 2000, the Bharatiya Nyaya Sanhita, 2023 (BNS), and all other applicable statutes.
  • All information and data you have submitted is accurate to the best of your knowledge.

Jaishree Exports does not verify the identity of users or confirm ownership of submitted data. The sole legal and moral responsibility for the accuracy, ownership, and legality of submitted data rests entirely and exclusively with the user.

04. Automated Phone & Email Scan

The phone and email scan is conducted using automated third-party tools against known breach databases and open digital footprint sources. Results are provided on an as-found, informational basis only.

Scan My Shadow does not guarantee that all existing exposures will be detected. The absence of a result does not mean your data has never been compromised — only that no match was found in the sources available at the time of scan.

Results must not be used as the sole basis for any legal, financial, personal, or professional decisions affecting yourself or any other person.

05. Image & Face Search

The image scan uses similarity-based technology to identify potential visual matches across publicly indexed platforms. All image scan results undergo human review by a trained Scan My Shadow team member before being included in your report.

Results are probabilistic, not conclusive. A match does not confirm identity theft or misuse — it indicates a visual similarity that may warrant further personal investigation.

Jaishree Exports, its proprietor Siddharth Gupta, its employees, and service partners bear no liability whatsoever for any action taken or not taken by the user based on image scan results.

Submitted photographs are used solely for the scan, are not shared with third parties beyond the scan process, and are permanently deleted within 96 hours of report delivery.

06. Prohibited Use & Illegal Activity

The following uses of Scan My Shadow are strictly and absolutely prohibited:

  • Scanning the personal data of any person without their explicit, prior, informed consent.
  • Using scan results to stalk, harass, intimidate, defame, blackmail, coerce, or cause harm to any individual.
  • Using scan results to commit or facilitate identity theft, fraud, impersonation, extortion, or any financial crime.
  • Using the service to gather intelligence on a third party for any malicious, competitive, coercive, or unlawful purpose.
  • Submitting false, fabricated, stolen, or otherwise unauthorised personal data for scanning.
  • Circumventing consent requirements through deception, manipulation, or coercion.
  • Any use that violates the Bharatiya Nyaya Sanhita 2023 (BNS), the DPDP Act 2023, the IT Act 2000, or any other applicable Indian or international law.

Absolute disclaimer of liability for misuse: Jaishree Exports, its proprietor Siddharth Gupta, its employees, agents, and any third-party service providers engaged in the operation of this platform bear absolutely no legal, civil, or criminal responsibility for any harm, loss, or damage — to any person, entity, or party — arising from a user's prohibited or illegal use of this service. This applies regardless of whether a warning was displayed, seen, accepted, or acknowledged by the user. The user alone is fully, exclusively, and unconditionally liable for all consequences of misuse, including but not limited to criminal prosecution, civil damages, regulatory penalties, and third-party claims.

07. Limitation of Liability

To the maximum extent permitted under Indian law, the total aggregate liability of Jaishree Exports, its proprietor Siddharth Gupta, its employees, agents, and third-party service partners — under any theory of law, whether in contract, tort, statute, or otherwise — shall not exceed the amount actually paid by the user for the specific transaction giving rise to the claim.

Under no circumstances shall Jaishree Exports or any associated party be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages of any kind.
  • Loss of data, reputation, earnings, business, or opportunity.
  • Emotional distress, psychological harm, or mental anguish arising from scan findings.
  • Any action taken or not taken by the user in response to scan results.
  • Any harm caused to a third party as a direct or indirect result of the user's conduct following use of this service.
  • Failure to detect all instances of data exposure, image misuse, or identity compromise.
  • Interruption, delay, or failure of any third-party tool, API, or platform used in the scan process.

This limitation applies even if Jaishree Exports has been advised of the possibility of such damages, and even if any remedy provided herein fails of its essential purpose.

08. Indemnification

You agree to fully indemnify, defend, and hold harmless Jaishree Exports, its proprietor Siddharth Gupta, its employees, affiliates, and all contracted third-party service providers from and against any and all claims, demands, investigations, damages, losses, liabilities, fines, penalties, costs, and legal expenses (including reasonable advocate fees) arising from or in any way related to:

  • Your use or misuse of the Scan My Shadow service.
  • Your violation of these Terms or any applicable law or regulation.
  • Personal data you submitted that you did not have the legal right to submit.
  • Any harm caused to a third party as a result of your actions before, during, or after use of this service.
  • Any false, misleading, or fraudulent representation made by you in connection with this service.
  • Any claim brought against Jaishree Exports by a third party due to your conduct.

This indemnification obligation survives termination or expiry of your use of the service and applies regardless of whether legal proceedings are initiated by a private individual, a third party, a government authority, or a regulatory body.

09. No Warranties

Scan My Shadow is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, completeness, or non-infringement.

Jaishree Exports makes no warranty that:

  • The service will be uninterrupted, timely, error-free, or complete.
  • All data exposures or image misuses will be identified.
  • Results will be accurate, current, or suitable for any particular purpose.
  • The absence of findings means the user's data has not been compromised.

The user accepts all risk associated with their use of the service and any action taken on the basis of results delivered.

10. Data Handling & Retention

All personal data submitted for scanning is handled in accordance with our Privacy Policy, which forms part of this agreement. Key commitments:

  • Scan data (email address and photograph): Permanently deleted within 96 hours of report delivery and cannot

11. Cooperation with Law Enforcement

Jaishree Exports will cooperate fully with Indian law enforcement agencies, judicial authorities, and regulatory bodies investigating the illegal use of this platform. Upon receipt of a valid legal order, we will disclose user identity, transaction records, and any other relevant information in our possession — without prior notice to the user.

Users who misuse this service should be aware that their identity and transactional records are traceable and will be shared with authorities upon lawful request. Scan data (email and photograph) is deleted within 96 hours and will not be available for production after that window.

12. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the service, or any breach thereof shall first be attempted to be resolved through good-faith negotiation between the parties.

If unresolved within 30 days, the dispute shall be referred to and finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a sole arbitrator appointed by Jaishree Exports, seated in Gwalior, Madhya Pradesh, India, and conducted in the English language.

The arbitral award shall be final and binding. Neither party may approach a court of law until the arbitration process has been fully exhausted, except for interim relief to prevent irreparable harm.

13. Refund Policy

Refunds are governed by the Scan My Shadow Refund & Cancellation Policy, published at refundpolicy.scanmyshadow.com, which is incorporated into this agreement by reference in its entirety.

14. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. If modification is not possible, it shall be severed from these Terms. All remaining provisions shall continue in full force and effect and shall not be affected by the severance.

15. Force Majeure

Jaishree Exports shall not be held liable for any failure or delay in service delivery caused by circumstances beyond our reasonable control, including but not limited to natural disasters, government orders, internet or platform outages, third-party API or tool failures, civil unrest, or any other force majeure event. In such cases, we will make reasonable efforts to resume service as soon as practicable.

16. Entire Agreement

These Terms, together with the Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and Jaishree Exports with respect to your use of Scan My Shadow. They supersede all prior or contemporaneous understandings, representations, warranties, and agreements — whether oral or written — relating to the same subject matter.

No waiver by Jaishree Exports of any breach of these Terms shall be construed as a waiver of any subsequent breach of the same or any other provision.

17. Amendments

Jaishree Exports reserves the right to update or modify these Terms at any time without prior notice. The most current version will always be published at termsandconditions.scanmyshadow.com. Continued use of the service after any amendment constitutes your unconditional acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

18. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause in Clause 12, any dispute that proceeds to court shall be subject to the exclusive jurisdiction of the courts of Gwalior, Madhya Pradesh, India.

By using this service, you irrevocably submit to the personal jurisdiction of these courts and waive any objection to proceedings in such courts on grounds of inconvenient forum or otherwise.
